So what is an apostille?

An Apostille is an official certification, often in the form of a stamp, used for authenticating public documents among countries that are part of the Hague Convention. These nations are known as signatory countries, formed by the Hague Conference on Private International Law.

Apostilles are only applicable to public documents, such as marriage, birth, and death certificates, as well as court documents, patents, and diplomas.

For a full list of participating countries and details on the process, contact Notary Express San Diego. We offer expert support and services for all your Apostille needs.

Navigating the Apostille process can be complex, especially if it's your first time dealing with document authentication. Our Apostille specialists will review your documents, advise you of any additional steps, and confirm eligibility within one business day—often even sooner. Let us simplify the process for you!

What you need to know about Apostille.

So what is an apostille?

An Apostille is a form of certification used to authenticate public documents for use in countries that are part of the Hague Convention. It serves as proof that a document, such as a birth certificate, marriage certificate, or diploma, is legitimate and can be legally recognized in other participating countries. The Apostille is a stamp or certificate attached to the original document by a designated authority, ensuring that the document is valid internationally without needing further legalization or embassy authentication.

Which Documents Require an Apostille?

The requirement for an Apostille depends on the receiving entity, but common examples of documents that often need authentication include:

  • Adoption paperwork
  • Corporate documents (articles of incorporation, mergers, amendments, by-laws, powers of attorney)
  • Powers of Attorney
  • School records (diplomas, transcripts, letters regarding degrees)
  • Birth Certificates and other vital records
  • Marriage licenses
  • Deeds of assignment
  • Job certifications and references
  • Trademarks

If you’re unsure whether your document requires an Apostille, it’s best to consult with the organization or authority requesting the document to confirm. We’re here to assist with the entire process!

How Do I Begin?

The process is simple and stress-free:

Apostille vs. Legalization: What's the Difference?

Apostille is a simplified form of document authentication used by countries that are part of the Hague Apostille Convention. Currently, over 200 countries accept foreign documents certified by an Apostille. However, there are some exceptions. Certain countries may refuse to accept documents apostilled by other member countries despite both being signatories. For example, Germany, Belgium, Greece, and Spain do not recognize documents apostilled in Albania, Kyrgyzstan, Uzbekistan, Mongolia, and the Dominican Republic, even though all these nations are part of the Hague Convention.

In such cases, or if the documents are intended for use in a country that is not a member of the Apostille Convention, a more complex process known as Legalization is required. This involves multiple steps, including embassy or consular legalization, to authenticate the document for use in non-Apostille countries.

Key Differences:

  • Apostille: A one-step certification for use in Hague Convention countries.
  • Legalization: A multi-step process required for countries outside the Apostille Convention or in cases where the Apostille is not recognized.

Legalization involves additional steps through foreign authorities, ensuring the document is valid for international use.

Our Process

How to Organize Documents for Apostille:

  1. Prepare the Original Documents: Ensure that the documents you need apostilled are original or certified true copies. Apostilles are generally only issued for public documents like birth certificates, diplomas, or corporate records.
  2. Get Documents Notarized (if required): Some documents, such as powers of attorney or corporate agreements, must be notarized before an Apostille can be issued. Please note, we offer notarization services only in California (CA) and Texas (TX).
  3. Verify Eligibility: Double-check that the country where you’re sending the documents is a member of the Hague Convention. If it isn’t, you may need to go through the legalization process instead.
  4. Group Similar Documents Together: Organize documents by type (e.g., birth certificates, corporate documents) to streamline the process. This helps if certain documents require additional steps like notarization.
  5. Ensure Proper Identification: Make sure you have valid ID ready in case it’s required during the notarization or apostille process.
  6. Make Copies for Your Records: Keep copies of all documents for your own records before submitting them for the apostille process.

By following these steps, you’ll ensure your documents are organized and ready for apostille certification with minimal delays.
